1. About the program
The Referral Partner Program lets approved partners recommend Heron Botanicals products to people who are expecting them. This agreement is between Heron Botanicals ("Heron," "we") and you, the Referral Partner ("you").
You accept this agreement by checking the box on the Recommend form the first time you send a recommendation. It applies to every recommendation you send after that, under the version in effect at the time (version 2026-10).
These terms add to any other Heron account terms that apply to you, such as the Wholesale Account Terms. If they conflict on a program matter, these terms apply. They replace the Practitioner Recommendation Program Terms.
2. Who can be a Referral Partner
Referral Partners are customers Heron has approved to send recommendations. Heron decides who is approved, and may decline or remove any account at its discretion.
- Business (B2B) accounts: approved practitioner and business accounts can send recommendations unless Heron turns this off for that account.
- Other accounts: individual accounts, including students, can send recommendations only after Heron approves them for the program.
- Not transferable: your partner access is for you. Don't share your login or let others send recommendations from your account.
3. Sending recommendations
Each time you send a recommendation, you confirm that the person is expecting it and has agreed to receive email from Heron Botanicals. You may recommend to anyone who meets that standard; you don't need to confirm any particular relationship with them.
- What you send: the person's email address and the product and size you recommend, using the Recommend form on the product's page while signed in. Nothing else is collected.
- What they receive: a short email from Heron saying recommendations are ready. It doesn't name the products or you. Several recommendations to the same email within about 15 minutes are grouped into one email.
- Limits: you may send up to 30 recommendations a day. Heron may refuse, delay, limit or remove any recommendation, for example if a product is discontinued or restricted.
- Accuracy and changes: you're responsible for the accuracy of what you submit. Tell us promptly when a recommendation should change or end. A person can also ask us to remove their recommendations or close their account at any time.
- Your confirmation: Heron sends you a confirmation email for each recommendation recorded. If you didn't send one, tell us right away.
4. What the people you recommend to get
The people you recommend to buy directly from Heron, at 15% off the suggested retail price. Heron sets prices and may change them at any time.
- They sign in to their own Heron account with the email you entered, using a one-time code.
- They can buy only the products and sizes recommended to them, plus products Heron sells to the public.
- Heron makes the products, fills their orders and handles shipping and order issues. Heron's Client Account Terms apply to their purchases.
- Their orders are final sale, except for damaged, defective or incorrect items.
- Heron refers their questions about whether a product suits them, or how to use it, to you.
5. Privacy and data
Heron collects only an email address and the products recommended to it. We use that email for the person's account and messages about their recommendations, and we never sell email addresses.
- Don't send health information. Don't include names, conditions, symptoms, diagnoses, reasons for a recommendation or any other personal details. The form has no place for them, and you agree not to send them to Heron by email, phone or any other way in connection with a recommendation.
- No relationship is recorded. Heron records which partner account sent a recommendation, but not any relationship between you and the person.
- Your own records are your responsibility. Heron doesn't keep notes, intake forms or records for you.
6. Your responsibilities
You are responsible for your recommendations and any guidance you give about them. Heron supplies the products; it doesn't advise the people you recommend to.
- Directions are your judgment. Any directions you give, including amounts and frequency, are your own judgment and responsibility, whether or not they match our label. Heron's guidance for each product is limited to the suggested use on its label, and Heron doesn't review your directions.
- Product statements. When you describe Heron products, don't describe them as diagnosing, treating, curing or preventing any disease, and don't imply Heron endorses a particular use. Don't present your recommendations as prescriptions or as coming from Heron.
- Stay within your training. Recommend only within your training and any license, scope of practice or privacy rules that apply to you.
- Keep your account secure. Recommendations sent from your account are treated as yours.
7. Products you can recommend
Heron decides which products can be recommended. The Recommend form appears only on products that are available for recommendation.
- Some products can't be recommended at all, and Heron may change which ones at any time.
- Some products may require additional approval before they can be sold to the person you recommend to. Heron may hold or cancel an order that doesn't meet its purchase rules.
- Availability, sizes and stock can change. Heron isn't responsible for products that are discontinued or out of stock.
8. Changes, suspension and ending
Heron may update this agreement. When it does, you'll be asked to accept the new version on your next recommendation, and you can't send more until you do.
- Suspension: Heron may pause or remove your partner access at any time, including for complaints, misuse, a breach of this agreement or the closing of your Heron account.
- Ending: you can stop participating at any time by contacting us.
- After it ends: Heron may keep or remove the recommendations you already sent.
9. General terms
You are an independent party, not Heron's employee, agent or representative.
- Indemnification: you agree to defend, indemnify and hold Heron harmless from claims, losses and costs, including reasonable attorneys' fees, arising from your recommendations, the directions you give, statements you make about our products, or your breach of this agreement. This doesn't cover claims caused by a defect in a Heron product.
- Limitation of liability: to the extent the law allows, Heron isn't liable for indirect or consequential losses, including lost profits. Our total liability for any claim under this agreement is limited to the amount paid for the product involved.
- Governing law: Washington State law governs this agreement, with venue in Kitsap County, Washington.
